The distinguishing factor is the Stingray device "forces" your phone to connect to it, by using a " deceptive signal ". Your phone's signal essentially is being"rerouted away fron the phone carrier's signal tower- to the stingray's capture signal". The device does not distinguish specific phones. Rather it gathers all signals ( everybody's phone signal ) within the given area. So it "traps" multiple phones at once. Trap & Tap

It is also identity theft. The device is stealing the identity of a proper cell tower in order to make a connection! Each point of connection is a "handshake" with the service provider of the tower, which is, in turn, just an extension of the service provider! There are a number of other laws that they are breaking as well!
