Ever heard a cop say, "I can't help you if you aren't honest with me"? This is them fishing for more information and trying to get you comfortable with answering their questions. They are trying to get you to feel safer so you will be more honest and then they will arrest you. Invoke your fifth amendment right to remain silent and do not consent to any testing or breathalyzing.

Remember, you don't even have to be drunk to be arrest for a DWI! Even if you're just nervous, the cops could see your behavior as "acting impaired," so they arrest you. It's not up to them to determine beyond a reasonable doubt that you are drunk.

Police routinely cite unverifiable observations, such as bloidshot watery eyes, jittery, fast talking, slurred speech, etc. The courts accept these statements unquestioningly.

The only 6 words I utter in front of a cop asking me questions go in this order…. “I don’t answer questions”…if they continue asking, then it’s “supervisor”…if they continue asking the same,or any really, questions then it’s “lawyer”!

Notice they don't usually specify alcohol when they ask if you had anything to drink. "Anything" could be water.

Isn’t it interesting how the entire criminal justice system, from police investigations all the way through sentencing is nothing more than an opinion? A cops OPINION if a crime was committed, a prosecutors OPINION of if they can get a conviction, their OPINION of the facts, the OPINION of the jury, the OPINION of the judge… our CJS isn’t based on fact, guilt, or innocence. It’s based on opinion and the ability of two lawyers to convince a jury their opinion is the right one.
