Even if click-through terms&conditions or EULAs are upheld when they have onerous or heavily slanted terms, thereā€™s no effing way that a T&C for using a streaming video service should have any bearing on someone dying at a theme park in circumstances that had nothing to do with the streaming video service.

The craziest thing is itā€™s only 50k heā€™s seeking and theyā€™ll spend 10-20x that in legal fees to not pay up. They should have taken the free good press and paid the man, changed policy to reflect food allergies on menus and moved on. The greed and hubris of these companies has no bounds.

There's no way the T&Cs in one business segment should protect a conglomerate against a consumer in an entirely different business segment. Imagine if you couldn't sue Walmart Insurance Services for not paying out on a claim because of T&Cs you agreed to when redeeming in-store coupon cards. Or even more segmented; imagine you couldn't sue Mars over mislabelled allergy information because of the T&Cs of one of the Pedigree, one of the Pet Care brands they own.

US contract law is so wrong. In democracies, it is illegal to get people to sign their basic rights away. Contracts that violate basic rights or absolve a company from basic duty of care should be null and void.

In europe/germany there is a very easy fix to the problem with terms and conditions. The terms and conditions hold up in court as long as there are to be expected in the general idea of the transaction. This means that no company can steal your firstborn after you agreed to a free trial, because that is not usually a term of a transaction in streaming services. Same holds true for any terms and conditions in stores, that regularly apply if you walk into the shop. Imagine going into a store/opening a website and just by doing so you could face all kinds of trouble.. only the usa..

Forced arbitration clauses should be illegal. Arbitration can be a good option for smaller lawsuits like the kind that would end up in small claims court, but wrongful death like this should never be settled via arbitration.

now i'm no lawyer. far form it but couldn't they argue that he was signing for the disney app and not signing for the disney park. I don't understand how a contract can be enforced when the issue wasn't involving the service he signed the terms and agreement for.
